All public employers are covered employers under the FMLA. However, if your organization does not have a minimum of 50 employees, then your employees would not be eligible for FMLA benefits. This is a fine distinction, but an important one, when considering federal notice requirements. Make sure you have a federally-required FMLA notice on your employee bulletin boards. And, always provide an FMLA notice to any employee who may have an FMLA-qualifying condition. Just include in the employee notice they are not eligible because your organization does employ 50 people.
